A coalition of conservative legal groups is calling on the Senate Judiciary Committee to investigate Kagan after accusing her of failing to recuse herself from Suncor Energy v. Boulder County, a closely watched climate lawsuit expected to be argued before the Supreme Court during its next term.
In a letter sent Monday to Senate Judiciary Committee leaders, the organizations contend that Kagan may have violated federal ethics rules by remaining involved in the case despite what they describe as her previous public endorsement of legal theories that sit at the heart of the dispute.
The coalition argues that the appearance of impartiality is just as important as impartiality itself, particularly in cases carrying enormous legal, economic, and constitutional implications.
