Fauci Evades Second Senate Panel, Invokes Fifth Amendment Amid Mounting Calls for Accountability

Senator Ron Johnson (R-Wis.), chairman of the Permanent Subcommittee on Investigations, revealed that Dr. Fauci's attorneys flatly rejected an invitation for a private transcribed interview concerning the federal government's handling of the COVID-19 pandemic. For millions of Americans still reeling from the devastating policies enacted under his guidance, this evasion only deepens suspicion and frustrates the search for truth.

In an August 14 letter to Senator Johnson, Dr. Fauci's legal team, David Schertler and Danny Onorato, argued that their client had already answered questions "honestly and transparently" in over 200 congressional appearances during his 38 years as director of the National Institute of Allergy and Infectious Diseases (NIAID). They claimed Dr. Fauci "stands by all his prior testimony," a bold assertion considering the public's lingering questions and the committee's push for accountability.

The attorneys also highlighted Dr. Fauci's invocation of his Fifth Amendment right against self-incrimination during a contentious July 29 hearing before the full Senate Committee on Homeland Security and Governmental Affairs. During that hearing, Dr. Fauci reportedly declined to answer more than 100 questions, an astonishing act for a public official who once proclaimed he had "nothing to hide." That refusal directly led to the committee's 8-5 party-line vote on August 6 to hold him in contempt, with the resolution then sent to the Justice Department for potential prosecution.

Dr. Fauci's legal counsel did not hold back in their letter, accusing Republican committee members of joining a "years-long vindictive crusade" led by Senator Rand Paul (R-Ky.). They further argued that Senator Paul's referral of the contempt resolution to the Justice Department, without the full Senate's consideration, did not meet statutory requirements for prosecution. They even suggested that if the committee truly wanted to test Dr. Fauci's Fifth Amendment claim, it should bring a civil action in federal court.

The attorneys doubled down, stating that Dr. Fauci would again invoke the Fifth Amendment if compelled to appear before Senator Johnson's subcommittee, claiming any subpoena would lack legislative purpose and serve only to "impermissibly harass or degrade Dr. Fauci for political purposes." They also cited unspecified harassment and death threats against Dr. Fauci and his family since the July 29 hearing, painting a picture of a man under siege rather than one accountable to the American people.

Senator Johnson, however, remains undeterred. "The American people deserve answers to legitimate questions regarding our miserably failed response to COVID-19," he declared in a statement. "Some of those questions can only be answered by Dr. Fauci." Johnson didn't miss the opportunity to highlight Dr. Fauci's past assurances: "Dr. Fauci previously said he was 'very happy to testify before any congressional oversight committee' and had 'nothing to hide.' Apparently, he has a lot to hide." And there it is.

The Wisconsin Republican vowed that his subcommittee would continue to pursue Dr. Fauci's records and seek interviews with individuals who worked closely with him. "We will explore our legal options before deciding our next steps," Johnson confirmed, promising that the fight for transparency is far from over.

This renewed push for answers comes as Senator Johnson's subcommittee recently obtained a copy of Dr. Fauci's government-issued iPhone from the Department of Health and Human Services. This device, used during the pandemic, contained a trove of over 34,000 text messages and 522 voicemails, a treasure trove of potential insights into the inner workings of the federal response.

On August 10, Senators Johnson and Paul released a batch of these messages from January 2021, revealing Dr. Fauci, then-CDC Director Dr. Rochelle Walensky, and then-Surgeon General Dr. Vivek Murthy discussing the alarmingly limited data available on COVID-19 vaccination during pregnancy. In one exchange, Dr. Fauci himself noted that fever and cytokine responses following a second vaccine dose "theoretically could be associated with miscarriage in the 1st trimester." While he also mentioned some positive data, the exchange starkly highlights the internal concerns federal officials harbored even as they pushed for widespread vaccination.

These messages raise critical questions about whether the public was adequately informed about potential risks, especially for pregnant women, when federal officials recommended vaccination. For far too long, American families were told to "trust the science" while key officials like Dr. Fauci appear to have harbored private doubts, now revealed through congressional oversight.

Dr. Anthony Fauci's continued stonewalling and reliance on the Fifth Amendment—a constitutional protection designed for those facing criminal charges—only reinforce the urgent need for complete accountability. The American people deserve to know the full truth about how their government handled a crisis that upended lives, economies, and freedoms.
