RICHMOND, Va. — In a stinging rebuke to far-left sanctuary state policies, a federal judge has issued an emergency order blocking key provisions of Virginia Democratic Governor Abigail Spanberger's anti-ICE legislation, delivering a massive blow to her administration's attempts to kneecap federal immigration enforcement.
U.S. District Judge Robert E. Payne granted an injunction requested by the U.S. Department of Justice against Senate Bill 783 and House Bill 1441, which were signed into law by Spanberger earlier this year. The radical state statutes attempted to impose a dozen restrictive conditions on local law enforcement agencies entering or maintaining 287(g) cooperation agreements with U.S. Immigration and Customs Enforcement (ICE). The law mandated that existing local agreements be rewritten to include state-level constraints—including prohibiting federal immigration enforcement near schools, faith-based organizations, courthouses, and polling places—or face immediate cancellation.
Judge Payne ruled that the federal government is overwhelmingly likely to succeed in its legal challenge, writing that Virginia's aggressive restrictions unconstitutionally impair valid federal contracts and represent an unlawful attempt to "regulate conduct of federal law enforcement in the enforcement of federal immigration laws". By blocking the state from enforcing its anti-ICE mandates, the ruling safeguards active 287(g) agreements between Virginia sheriffs and federal agents, allowing critical border security operations to continue unhindered across the Commonwealth.
Republican leaders and law enforcement advocates praised the court's intervention, noting that conservatives repeatedly warned Spanberger’s administration that its attempts to shield illegal aliens from federal authorities would waste taxpayer money and collapse under judicial review. Former Virginia Attorney General Jerry Kilgore blasted the governor's efforts as transparent "political theater" designed to appease left-wing activist groups at the expense of public safety.
