The Cost of Activist Benches: Illegal Alien Released by Clinton-Appointed Judge Charged with Brutal Rape in Minnesota
MINNEAPOLIS, MN — When progressive federal judges decide that immigration laws are optional suggestions rather than hard boundaries, everyday Americans are the ones left to pay the horrific human toll.

A Honduran illegal alien who was ordered released from immigration custody by a federal judge has now been charged with the brutal rape of a Minnesota woman inside her own home, according to federal immigration authorities and local law enforcement.

Marcotulio Melendez Diaz, a 42-year-old national of Honduras, was initially caught and released into the United States interior at the southern border by the Biden administration in 2024. After Immigration and Customs Enforcement (ICE) agents subsequently tracked him down and arrested him during an enforcement sweep, an immigration judge ordered him deported. But instead of being flown out of the country, Melendez Diaz challenged his detention in federal court, where a Clinton-appointed judge intervened to order his release.

The Board of Immigration Appeals officially rejected his deportation appeal and issued a final removal order on October 9. Just two days later, authorities state that Melendez Diaz—working as a handyman—forced his way into a Mounds View woman's home and allegedly subjected her to a violent, repeated sexual assault.

ICE officials did not mince words regarding the catastrophic failure of judicial activism, issuing a blunt statement on the tragedy: "This is what happens when activist judges side with criminal illegal aliens over Americans."

For years, the radical establishment has fought tooth and nail to handcuff law enforcement, hamstring deportations, and open the floodgates to unvetted migrants under the banner of compassion. But as another innocent American family suffers the unimaginable consequences of judicial leniency toward criminal aliens, the reality is stark. Common-sense border security and public safety are inseparable—and until activist benches stop prioritizing foreign lawbreakers over the safety of U.S. citizens, innocent communities will continue to bear the cost.
