Sacramento, CA – In a move that defies common sense and prioritizes radical ideology over fairness, California Governor Gavin Newsom’s office celebrated a federal judge’s dismissal of a Trump-era Department of Justice (DOJ) lawsuit. This ruling, based on a technicality, allows California to continue its deeply controversial policy of permitting biological males to compete in girls' high school sports, a policy that is a direct affront to the integrity of women's athletics.
The procedural dismissal by U.S. District Judge Cynthia Valenzuela did not, critically, rule on whether California’s policy itself violates Title IX – the landmark 1972 law designed to protect female athletes. Instead, the case was tossed on grounds that federal officials allegedly failed to provide California with sufficient notice regarding potential loss of federal education funding. A convenient out, it seems, that leaves girls’ sports vulnerable.
Newsom’s administration wasted no time gloating over the setback for American values. A spokesperson for the Governor’s office, in a statement clearly aimed at political point-scoring, declared, "This ruling makes clear that President Trump cannot rewrite Title IX by fiat. He cannot weaponize the law against the American people, and California will keep fighting his attempts to do so." The irony, of course, is that the Trump DOJ was attempting to protect Title IX's original intent, not rewrite it. Meanwhile, California weaponizes a distorted interpretation of the law against its own female athletes.
The Department of Justice expressed its disappointment, asserting, "We are disappointed by the Court's order and remain committed to enforcing President Trump's agenda of preventing boys from playing in girls' sports." That commitment is precisely what concerned parents, coaches, and athletes nationwide are looking for as the battle for fair play continues.

Under Governor Newsom’s leadership, California has staunchly maintained a 2013 policy that explicitly allows males to compete on girls’ teams. This is despite Newsom himself acknowledging in a past podcast that "fairness" is at the heart of the debate over transgender athletes. A candid admission that apparently now holds little weight against the political winds of the radical left.
The devastating real-world consequences of this policy are already stark. The case of Jurupa Valley High School athlete AB Hernandez became a national flashpoint, as Hernandez secured four girls’ state titles in track and field over two seasons. From high jump to triple jump championships, Hernandez’s participation pushed deserving female athletes off the podium, forcing officials to issue duplicate medals to those displaced. The debate escalated further when Hernandez joined the girls’ varsity volleyball team, raising serious concerns not only about competitive fairness but also about player safety.
Reports indicate at least eight teams forfeited games against Jurupa Valley, citing both fairness and safety concerns when faced with competing against a male. While state officials attempt to downplay the issue by pointing to the "few" trans athletes competing in California, female athletes and advocates rightly argue that even one male competitor can drastically alter state championships, costing girls scholarships, college opportunities, and their rightful place in sports history.

With the federal case currently stalled, California remains a critical battleground for the future of Title IX and the fundamental principles of women’s sports. This isn't just a legal skirmish; it's a fight for common sense, for the integrity of athletic competition, and for the protection of American girls who deserve a level playing field. The America First movement will continue to champion these core values against the woke agenda that seeks to dismantle them.
