Marcos Iriarte-Valdez, an illegal immigrant from Venezuela with Spanish citizenship, is now charged with the shocking murder of Todd Stewart in Martinez. Stewart, a respected, long-time resident of his quiet neighborhood for some 40 years, was allegedly stabbed and killed by Iriarte-Valdez during an attempted burglary after encountering him in his garage.
The Department of Homeland Security (DHS) had already placed an immigration detainer on Iriarte-Valdez, seeking his transfer to federal custody. He was already facing multiple burglary charges stemming from at least two incidents elsewhere in Contra Costa County, just east of San Francisco. Yet, despite these clear red flags and the federal request, a California judge ordered his release on his own recognizance just 24 hours before Stewart's horrific death. Apparently, common sense needed a permission slip.
DHS has unequivocally slammed California officials, demanding Governor Gavin Newsom immediately turn Iriarte-Valdez over to federal authorities for removal from our nation. "Valdez is charged with murder, inflicting corporal injury on spouse, three counts of burglary, receiving known stolen property, trespassing, entering non-commercial dwelling, loitering, as well as convicted of violation of court ordered protective order," the department outlined in a statement.

Iriarte-Valdez was on pretrial release in connection with burglaries at occupied residences in April when he was briefly arrested for allegedly violating a home detention condition. A homeowner previously targeted by Iriarte-Valdez during his April alleged burglary spree expressed profound shock that the man had been released. The homeowner recounted his 83-year-old wife seeing Iriarte-Valdez’s reflection and screaming, which he believes caused the suspect to take off.
DHS further clarified that Iriarte-Valdez was legally admitted to the U.S. during the George W. Bush administration but has since been classified as an "illegal alien."
The agency reiterated the critical importance of law enforcement cooperation: "The safest way to arrest and remove criminal illegal aliens from our streets is by lodging arrest detainers. Because sanctuary cities refuse to work with ICE law enforcement, criminal illegal aliens are released from jails into American communities to perpetuate more crimes."
