PROVO, Utah— A Utah state judge has ordered Tyler Robinson to stand trial on all seven criminal counts in the brutal assassination of conservative leader Charlie Kirk, keeping the death penalty firmly on the table after determining prosecutors established sufficient probable cause.

Judge Tony Graf issued the pivotal ruling from the bench following a preliminary hearing, ruling that the state met its legal burden to proceed with capital punishment allegations and victim-targeting enhancements. Addressing the courtroom, Judge Graf emphasized the evidentiary threshold at this stage, stating, "The question at this stage, however, is not whether the state proved the aggravator beyond a reasonable doubt. Because credible evidence and reasonable inferences support probable cause as to each element, under that limited standard, the state has met its burden." The judge noted that whether the state ultimately proves the aggravating factors beyond a reasonable doubt "remains for trial."

Immediately following the ruling, the court proceeded directly into formal arraignment. Defense attorney Kathryn Nester waived the reading of the indictment before entering pleas of not guilty on Robinson's behalf to all seven charges.

The Kirk family released a poignant statement following the court's decision, calling the ruling a critical milestone nearly one year after the tragic murder. "Today's decision, which comes nearly a year since Charlie was taken from us, marks an important step in our family's pursuit of justice for him," the family stated, noting that every stage of the legal process carries "the weight of all that Charlie's murder has taken," particularly for Kirk's young children who "will grow up without their father." The family reaffirmed their commitment to seeking full justice while praying for "a transparent and timely process" as the capital murder case advances toward trial.
