DHS General Counsel James Percival didn't mince words, declaring on X that there is "no serious debate about what is going on in these cases—defiance, obstruction, and delay." He slammed such actions as "naked political activism" from a select group of federal district judges.

Judge Burroughs' order reportedly relies on an amended complaint by plaintiffs, African Communities Together, which continues to push "spurious allegations" of racial and national-origin discrimination. As Rep. Ogles pointed out, this is leveled against an administration that had not renewed a single temporary protected status designation. It appears to be a transparent attempt to bypass the Supreme Court's clear guidance in Mullin v. Doe.
