The Department of Health in Pennsylvania, under Democrat Governor Josh Shapiro, has been forced to abandon a sweeping overhaul of the state’s health code. This significant retreat comes after an "incredible outpouring" of public concern, effectively derailing a proposed regulation that would have granted state bureaucrats unprecedented authoritarian powers.
Secretary of Health Debra Bogen submitted a letter on September 25, confirming the Department's withdrawal of the regulation. This highly controversial proposal sought to arm the state with unchecked authority under the guise of "disease control measures," including the power to enter private homes and schools without a warrant, access confidential medical records, and unilaterally impose statewide school mask mandates. Such a move would have sidestepped the will of Pennsylvanians who, in May 2021, voted to limit the governor's unilateral emergency powers through a constitutional amendment.
"Withdrawing these regulations following the incredible outpouring of legislative and public concern about their overreach is the correct and logical conclusion for the Department of Health," stated Pennsylvania House Republican Leader Jesse Topper, underscoring the vital role of citizen engagement in safeguarding liberties. "Going forward, it would be my hope the Department would solicit legislative and public input prior to drafting any new regulations."
The initial exposure of this egregious power grab can be largely attributed to a bombshell report from The Daily Wire. Published on August 24, the report ignited a furious backlash, transforming what had been a quiet bureaucratic process into a statewide controversy. Before The Daily Wire's intervention, only 18 public comments on the regulation were recorded by the Independent Regulatory Review Commission. However, following the report, the Pennsylvania GOP reported that the Shapiro administration "received over 6,000 appeals from the public" on social media.
Pennsylvania Treasurer Stacy Garrity praised the vigilance of her fellow citizens. "The least transparent Governor in America got caught trying to sneak a 502 page invasion of privacy and parental rights through, and he was caught," Garrity wrote on X.
