A California high school is embroiled in a fiery lawsuit, accused of a shocking campaign of retaliation against students who dared to express pro-Trump views on campus. The allegations claim that teachers and administrators at Torrey Pines High School went so far as to subject one student to a mandatory psychiatric hold, a move critics say is a chilling overreach against conservative speech.
The legal filing details how two students, identified only as A.F. and M.F., attended a February 6 rally at the San Diego campus. What began as a protest against Immigration and Customs Enforcement (ICE) quickly shifted when the students arrived to voice support for President Donald Trump’s administration. M.F. carried a printout of the letters “LGBT,” cleverly designed with the Statue of Liberty for "L," a rifle for "G," a glass of beer for "B," and a photo of Trump for "T."
The situation escalated sharply. M.F. reportedly returned to class still carrying the flyer, prompting his teacher to immediately become upset and abandon the classroom. Just three days later, according to the lawsuit, Assistant Principal Angela Guerrero summoned M.F. and another student, informing them they faced two days of detention because the flyers had "frightened" other students.
The harassment did not stop there. That same week, M.F. was called into the vice principal’s office alone, facing far more serious accusations: that he had made "disturbing searches" on a school computer, including "how to load a Glock," "how to load a magazine," and "how to dispose of a body." M.F. vehemently denied making these searches, explaining that other students routinely used classmates’ unprotected school computer logins. Initially, Assistant Principal Guerrero appeared to accept his explanation and sent him back to class.
However, the next day brought a dramatic escalation. Five to six police officers arrived at the school and interrogated M.F. himself. According to the lawsuit, "School officials refused to allow M.F.’s parents to see him, instead requiring them to speak with a crisis social worker. The crisis social worker stated that [M.F.’s teacher] requested the police because the searches made Defendant [Theresa] Barnes feel ‘scared’ and ‘unsafe.’"
Following this interrogation, M.F. was taken into custody and delivered to a mental health facility on a 5150 psychiatric hold. While the student was held overnight, law enforcement executed a search of his home and bedroom, finding absolutely nothing to substantiate the accusations against him. The lawsuit directly refutes the school’s claims, stating, "M.F. did not research how to load a ‘glock,’ did not confess to murder, was not watching homicide videos, and did not target the LGBT community. The claims were completely false, as school officials were fully aware."
Despite the police finding no evidence of wrongdoing and M.F. being allowed to return to school, the alleged harassment continued. Administrators reportedly referred to him as an "LGBT bully," barred him from playing varsity baseball, compelled him to attend counseling sessions, and pushed him toward testing for "Special Education placement and ongoing mental health monitoring."
This is not the first time Torrey Pines High School has drawn criticism for its handling of student expression. The same school previously faced scrutiny when students were permitted to carry signs comparing ICE to the KKK, yet another student was suspended for flyers that simply read, "We love I.C.E. — real Americans." That suspension was eventually reversed by the district, but only after significant pressure from free speech advocates.
This lawsuit serves as a stark reminder of the battle for free speech in America's educational institutions and the alarming trend of school administrations targeting students for their conservative beliefs. Parents and taxpayers should demand accountability from officials who prioritize political agendas over fundamental First Amendment rights and due process for young Americans.
