A recent horrific crime has ignited a firestorm of outrage in Florida, with Polk County Sheriff Grady Judd delivering a scathing indictment of lax border policies after a 24-year-old Honduran illegal immigrant was arrested for the brutal sexual assault of a 77-year-old woman in her own home. Sheriff Judd pulled no punches, calling it "one of the most horrific crimes that we’ve seen in this county in a very long time" and emphasizing a stark truth: this heinous act "couldn’t have occurred if [Herrera] was not in this country."
The suspect, Axel Antonio Espinal Herrera, is now facing a litany of serious charges following what authorities describe as an "over-the-top," "vicious sexual battery." Judd’s fury was palpable as he spoke about the escalating nature of such crimes, particularly when compounded by the suspect's unlawful presence in the United States. "Sexual battery of an individual is without a doubt one of the most horrific crimes that occurs. And a violent, out-of-control sexual battery on a stranger even elevates that one more level. And then you take on top of that the suspect is in this country illegally, that pushes it over the top," Sheriff Judd stated, laying bare the consequences of a broken border.
The terrifying incident unfolded around 4 a.m. on early Saturday morning, August 30. The elderly victim awoke to a noise, only to discover an unknown man in her bedroom. According to the Sheriff's Office, the intruder forcibly removed her clothes and subjected her to a sexual battery, slapping her when she bravely tried to resist. When she attempted to escape through her front door, the suspect chased her, dragged her back inside, and choked her.
After the assailant fled, the victim immediately contacted the Sheriff's Office. Swift investigative work by detectives led them to a nearby home, where they located Herrera alongside two other illegal immigrants, also from Honduras. Herrera, who was in the shower upon the detectives' arrival, matched the victim's description, and clothing consistent with her account was found in the residence. Investigators also noted multiple scratches on Herrera’s body, aligning with the victim’s statements, and discovered he was in possession of cocaine.
Herrera was taken into custody and is now facing charges including kidnapping, sexual battery by force, burglary and battery, tampering with evidence, possession of cocaine, possession of drug paraphernalia, and loitering and prowling. Under Florida law, each of these charges is elevated by one category due to his illegal status, potentially subjecting him to multiple life sentences. The Sheriff’s Office promptly notified U.S. Immigration and Customs Enforcement (ICE), which has placed a detainer on Herrera, ensuring he will not be released. The two other illegal immigrants found in the house were also taken into custody on ICE holds.
Sheriff Judd minced no words in his condemnation, labeling Herrera a "very violent, very dangerous rapist" whose actions were "graphically very vile and out of control." He concluded his remarks with a poignant question that echoes the frustrations of many Americans: "He was a young man, 24 years of age, sexually battering a 77-year-old woman after he broke into her house in the middle of the night. Do I need to say more?"
