Judicial Activism Unleashed: Biden Judge Blocks DOJ's Critical Election Integrity Probe in California, Bolstering Leftist Agenda
CA's Election Worker Unions Get a TRO, CHIRLA Gets DOJ's List, and DOJ Gets the Shaft

In a stunning move that sent shockwaves through the fight for election integrity, a Biden-appointed federal judge has delivered a severe blow to the Department of Justice's efforts to clean up California's voter rolls. This past Friday evening, District Judge Trina Thompson issued a sweeping Temporary Restraining Order (TRO) against the DOJ, effectively kneecapping federal attempts to address the concerning presence of likely non-citizens on California's voter lists.

The ruling came after a lawsuit filed by powerful leftist organizations, including the SEIU and AFL-CIO unions representing California election workers, alongside the NAACP and LULAC. These groups, represented by Norm Eisen's notorious outfit, accused the DOJ of "intimidat[ing], threaten[ing], or coerc[ing] election workers who aid others in exercising their right to vote." They demanded a TRO to prevent the DOJ from attempting to force the segregation of ballots from likely non-citizens and from "threatening" prosecution for what these groups claim is merely doing their job.

Remarkably, Judge Thompson, without the benefit of a hearing or any responsive pleading from the Department of Justice, granted the requested TRO. Her order explicitly states that the Defendants (the DOJ) are "temporarily enjoined and stayed, including under 5 U.S.C. §705, from the following":

  • Defendants shall not threaten, intimidate or coerce state or local elections officials or workers to demand that they halt processing the ballots of any registered voter solely on the basis that the ballot belongs to an individual alleged by Defendants to be ineligible to vote;
  • Defendants shall not demand that any state or local election official (i) remove specific registered voters from their statewide voter registration lists; (ii) refuse to issue ballots to specific registered voters; or (iii) segregate or otherwise not count any ballots cast by specific registered voters for the November 3, 2026 General Election, solely on the basis that the ballot belongs to an individual alleged by Defendants to be ineligible to vote;
  • Defendants shall not threaten state or local election officials and workers with criminal prosecution for failure to comply with such demands;
  • Defendants shall not threaten state or local election officials and workers with criminal prosecution for processing or counting ballots in the 2026 election in compliance with state and federal laws that govern election administration on the basis that a ballot belongs to an individual alleged by Defendants to be ineligible to vote.
  • The Court further ORDERS Defendants to inform any State, county, or any other local government to which any Defendant sent a letter regarding the processing and counting of ballots in the 2026 election and any list of individuals alleged by Defendants to be ineligible to vote that the demands and threats of prosecution to election officials and workers reflected in that letter have been enjoined.
  • The Court further ORDERS Defendant U.S. Department of Justice to inform the Court of any pending search warrant applications, grand jury subpoenas, or other demands to access election materials or ballots pertaining to any list of individuals alleged by Defendants to be ineligible to vote, or compel testimony related thereto.

The audacity of these demands from the bench is nothing short of breathtaking. Legal experts are already questioning the authority of this judge to issue such an expansive order. As Bill Shipley, a keen observer of legal matters, remarked, "There is black letter authority that a federal law enforcement officer can ADVISE anyone of the law and the possible consequences of violating the law. This judge is an idiot." It truly begs belief that a district judge believes she is "entitled to know about law enforcement activity" at this level. Because, of course, a Biden appointee would overstep in a way that shields potentially illegal voting from scrutiny.

Adding insult to injury on the very same day, across the country, another federal judge, Judge Boasberg, entered an order in a separate case. This ruling mandates that the DOJ provide CHIRLA – the California organization exposed by RedState for allegedly orchestrating and funding the anti-ICE riots in 2025 – with its list of approximately 20,000 "likely noncitizens" on California's voter rolls. This list is to be handed over so that CHIRLA can determine if any of its members appear on it. While the DOJ is being forced to hand over sensitive information, CHIRLA itself was caught operating as a Los Angeles County Flex Vote Center on Friday, allegedly breaking laws regulating conduct near polling places in the process.

These combined rulings represent a calculated assault on election integrity, making it abundantly clear that the progressive establishment is willing to use every lever of power, including judicial overreach, to obstruct efforts to ensure fair and legal elections. With the November 2026 General Election on the horizon, these blatant maneuvers to undermine the rule of law and safeguard dubious voter rolls demand immediate intervention. It's increasingly evident that the Supreme Court will have no choice but to step in, and soon, to protect the foundational principles of American democracy and restore faith in our electoral system.
