Biden-Era DHS Ignored Millions of Visa Overstays — Including Thousands Flagged as Security Risks

A new DHS Inspector General report is putting a staggering number on what critics of the Biden administration have long described as a failure to enforce America's immigration laws: ICE received more than 3.1 million leads involving visa overstays between 2021 and 2024, yet investigated fewer than 500 of those identified as potential national security or public safety threats.

The findings are difficult to square with the basic responsibility of the federal government: knowing who is in the country, enforcing the law and acting when someone presents a danger.

According to a report from DHS Inspector General Joseph Cuffari, roughly 104,000 of the more than 3.1 million visa-overstay leads were classified as potential national security or public safety threats.

Yet fewer than 500 of those leads were investigated.

Just eight visa overstays were ultimately arrested.

That is not a rounding error. It is a massive enforcement gap.

The report points directly to a September 2021 ICE directive issued under the Biden administration. The directive instructed agents to investigate only visa-overstay cases classified as “Priority 1,” effectively leaving millions of other cases without investigation.

Even within that supposedly highest-priority category, enforcement was remarkably limited.

Of fewer than 1,800 visa-overstay leads designated Priority 1, only 84 were investigated, according to the Inspector General. Those investigations resulted in just two arrests.

And that is where the national-security implications become impossible to ignore.

These were not simply administrative paperwork violations. Tens of thousands of people had been identified as potential threats to national security or public safety, yet the overwhelming majority were not investigated.

DHS Secretary Markwayne Mullin did not mince words in responding to the findings.

“The degree of the Biden administration’s dereliction of duty, which needlessly put American lives at risk, is staggering and enraging,” Mullin said.

The report offers a stark contrast between immigration enforcement philosophies.

Under the Biden administration, ICE was directed to narrow its investigative focus, leaving enormous numbers of visa-overstay cases untouched.

Under President Donald Trump, the current administration has made enforcement and removal of illegal aliens a central component of its America First agenda.

“Unlike the Biden administration, the Trump administration will always put the safety of the American people first,” Mullin said. “We will target and remove as many illegal aliens as possible to make America safe again.”

That difference is not merely political rhetoric.

A visa is permission to enter the United States for a defined purpose and period of time. When that period expires, the government has a basic obligation to determine what happened next.

Did the person leave?

Did they obtain lawful status?

Or did they simply disappear into the country?

A functioning immigration system needs answers to those questions.

The Inspector General's findings suggest that during the Biden years, millions of cases were effectively pushed down the priority list — including cases involving people who had been flagged as potential threats.

Americans have heard years of arguments about border security, asylum, deportations and illegal crossings. But immigration enforcement does not begin and end at the southern border. The legal immigration system itself depends on the government enforcing the conditions under which foreigners are admitted.

That part should not be complicated.

A country that cannot or will not enforce the terms of admission eventually loses control over its own immigration system.

The Trump administration now has the opportunity to reverse that approach. The priority should be straightforward: identify those who violate immigration law, investigate genuine security threats, remove those who have no legal basis to remain, and put the safety of Americans ahead of bureaucratic excuses.

The Biden-era record documented by the Inspector General shows what happens when enforcement becomes optional.

America First means it isn't optional anymore.
