BOASBERG Act Targets Corrupt Judicial 'Case Shopping,' Aims to Stop Anti-Trump Activist Judges

For too long, a cadre of activist judges has brazenly obstructed the America First agenda, directly challenging the will of the people and President Donald Trump's efforts to put our nation back on track. These judicial rogue actors have consistently overstepped their bounds, inserting themselves into critical public policy matters and undermining the rule of law.

At the forefront of this judicial overreach stands Judge Jeb Boasberg, a name that has become synonymous with judicial activism. His involvement in some of the most politically charged cases of recent years raises serious questions about the integrity of our courts.

Boasberg played a significant role in the scandalous "Russia hoax" through the secretive FISA court, presiding over the reauthorization of deeply troubling surveillance warrants against former Trump aide Carter Page. He was also a leading figure in numerous January 6th cases, and more recently, his fingerprints have been mysteriously found on high-profile immigration cases, including the controversial deportation of Venezuelan illegal aliens.

Now, Senator Eric Schmitt of Missouri is taking direct aim at this judicial menace with a bold new piece of legislation: the BOASBERG Act. This isn't just a clever acronym; it stands for the Blocking Overt Attempts at Shopping By Enforcing Randomization Guidelines Act—a much-needed reform to curb judicial manipulation.

"Judge Boasberg is the poster child for a rogue judge and exposed serious loopholes in our judicial system," Senator Schmitt stated, underscoring the urgency of this bill. "Randomly assigning cases among judges ensures the American people can have confidence in the impartiality of our courts."

Schmitt's bill is designed to implement robust measures against judges who exploit the federal case selection process. It mandates that courts enact a system of truly random case assignment within 120 days of its passage, stripping chief judges of the power to tamper with case selection. The act demands transparency, requiring courts to reveal their assignment processes, and crucially, it establishes penalties for any manipulation of case selection. Furthermore, it orders the random reassignment of a case should the Supreme Court intervene and overrule a judge.

Senator Schmitt made his intentions clear on social media, declaring, "One year ago, the DOJ filed its judicial misconduct complaint against Judge Boasberg. Today, I'm filing the BOASBERG Act to permanently block rogue judges from hijacking cases. Impeach Judge Boasberg. Pass the BOASBERG Act."

He further elaborated on the bill's core functions:

1. Randomize case assignments for federal district and appeals courts.

2. Implement transparency measures to verify randomized assignments are actually being followed.

3. Reassign a case away from a judge if SCOTUS overrules him in that case.

"This bill would put an end to rogue behavior like Judge Boasberg self-assigning cases to himself," Schmitt continued. He highlighted a glaring example: "The Alien Enemies Act case was filed on March 15, 2025. Judge Boasberg was not the emergency on-call judge. Yet *somehow* the case was steered to him." And somehow, they still expect Americans not to notice.

For too long, Congress has allowed unchecked judicial activism to wreak havoc on our nation, directly impacting President Trump's ability to govern effectively. The BOASBERG Act represents a vital step towards reining in unaccountable judges, restoring integrity to our courts, and ensuring that American justice is impartial, not a weapon wielded by the radical left against the America First movement.
