However, United States District Judge Roy K. Altman decisively sided with President Trump. The judge granted permission to file an amended complaint and, in a clear rejection of the BBC's arguments, rendered their previous motion to dismiss as "moot."
A spokesman for President Trump’s legal team hailed the decision, stating, "Today’s strong and thoughtful ruling is a major win for President Trump’s powerhouse lawsuit against the formerly respected and now disgraced BBC, which defamed President Trump by intentionally, maliciously and deceptively doctoring his speech in a brazen attempt to interfere in the 2024 Presidential Election. President Trump is holding the leftist BBC, along with all of its comrades in the mainstream media, accountable for their peddling of Fake News through deception and maliciously defamatory conduct."
The lawsuit centers on the BBC’s 2024 "Panorama" documentary, titled "Trump: A Second Chance?" The program came under intense scrutiny for its misleading portrayal of President Trump’s January 6th speech. The documentary notoriously stitched together remarks made nearly an hour apart, creating a false narrative that suggested Trump had directly urged his supporters to "fight like hell" at the Capitol just moments before the riot began.
The integrity of the BBC’s editing was further exposed by a whistleblower dossier compiled by Michael Prescott, a communications advisor hired by the BBC to review its editorial standards. Prescott’s findings confirmed the network’s deliberate splicing of two distinct comments, erroneously implying a call for violence from the then-President.
The doctored version presented in the documentary claimed Trump said, "We're going to walk down to the Capitol. And I'll be there with you. And we fight — we fight like hell." The truth, however, was far different. President Trump actually stated, "We're going to walk down to the Capitol. And we're going to cheer on our brave senators and congressmen and women, and we're probably not going to be cheering so much for some of them, because you'll never take back our country with weakness. You have to show strength, and you have to be strong." It was 54 minutes later that Trump urged his supporters to "fight like hell" for election integrity.
The fallout from this deliberate deception was significant, leading to the resignations of BBC CEO Deborah Turness and Director-General Tim Davie last year.
President Trump is expected to file the new version of his complaint shortly, focusing on personal reputational harm while continuing to seek the substantial $10 billion in damages.
