In a resounding victory for accountability and the rule of law, a federal appellate court has definitively sided with the Trump administration, refusing to dismiss a damning case against a radical House Democrat accused of physically assaulting federal immigration officers.
The U.S. Court of Appeals for the Third Circuit, with a crucial 2-1 decision including a Biden-appointed judge, rejected Rep. LaMonica McIver's (D-N.J.) desperate attempt to quash the Department of Justice (DOJ) case against her. This stems from a shocking 2025 incident at an Immigration and Customs Enforcement (ICE) facility in Newark, New Jersey.
The charges trace back to a chaotic May 2025 "unannounced visit" to the Delaney Hall detention center, where a group of Democratic officials, ostensibly on an oversight mission, devolved into a physical standoff with ICE agents. The spectacle culminated in the arrest of Newark Mayor Ras Baraka, while McIver herself faced three serious counts, including assaulting and impeding federal officers.
McIver, predictably, sought to have the case thrown out, arrogantly claiming legislative immunity and even labelling the charges "vindictive" – a familiar cry from the progressive left when faced with consequences. However, the appellate court saw through the political theater.
For two of the three counts, the court delivered a blunt rebuke. Regarding the charge that McIver allegedly "slammed her forearm" into a federal officer attempting to arrest Mayor Baraka, the court upheld a lower ruling stating her "alleged intervention into the Mayor's questionable arrest had no cognizable connection to any legislative function" protected by the Constitution. That part should not be complicated.
The second count detailed how McIver allegedly used both of her forearms to "strike [an officer] as she returned inside of the secured area of Delaney Hall." The judges were unequivocal, writing that "the acts of pushing past and forcibly striking someone are unambiguously non-legislative: they are not integral to the legislative process." Apparently, common sense needed a permission slip.
A lone dissenting voice, Judge Thomas Ambro, argued that preventing a Member from entering a DHS facility constitutes denying "effective access to an oversight inspection." But the majority clearly recognized the difference between oversight and outright assault.
McIver’s reaction was as defiant as it was predictable, declaring the court "got it wrong." In a statement steeped in the radical left's rhetoric, she claimed the decision "chills that authority and emboldens the Trump administration to continue persecuting our most vulnerable communities… and anyone who dares hold the president or his lackeys accountable." She vowed, "I will not fold to this administration. We are exploring every possible option… This is not over." Such declarations expose the true colors of those who believe they are above the law, even when assaulting those tasked with upholding it.
This ruling is a crucial reminder that even elected officials are not above the law, especially when their actions cross the line from political grandstanding to physical confrontation with federal agents.
